can be based on grounds of past persecution alone even though there is no
reasonable likelihood of present persecution. To establish such
eligibility, an alien must show past persecution so severe that
repatriation would be inhumane. The "well-founded fear of
persecution" standard contains both a subjective and an objective
component. An applicant may satisfy the subjective element by presenting
candid, credible, and sincere testimony demonstrating a genuine fear of
persecution. The objective element requires a showing of specific,
concrete facts that would lead a reasonable person in like circumstances
to fear persecution. </li>

under which a reasonable person would fear persecution. Such facts may be
in the form of documentary evidence demonstrating past abuse or threats of
future persecution. Where such documentary evidence is unavailable,
testimony of the applicant supports an application for asylum if it is
credible, persuasive, and refers to specific facts that give rise to an
inference that the applicant has been or has a good reason to fear that he
or she is singled out for persecution. </li>

Control over matters of immigration is a sovereign prerogative, largely within
the control of the executive and the legislature. Deportation and asylum
hearings, however, are subject to the requirements of procedural due
process. The appellate court reviews de novo a claim that the procedures
utilized in such hearings contravened due process or the Immigration and
Nationality Act. In order to prevail on a due process challenge to a
deportation or asylum hearing, an alien must demonstrate that he was
prejudiced by any such violation. Similarly, an alien must establish
prejudice in order to invalidate deportation proceedings on a claim that
his statutory or regulatory rights were infringed. And we may only find
prejudice when the rights of an alien have been transgressed in such a way
as is likely to impact the results of the proceedings.<o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; mso-list: l0 level1 lfo1; text-align: justify;">An alien is only
eligible for asylum if he is a refugee, and a refugee is any person who is
unable to return to his or her country because of persecution or a
well-founded fear of persecution on account of race, religion,
nationality, membership in a particular social group, or political
opinion. The standard for proving a well-founded fear of persecution is
the reasonable person test. Therefore, an individual seeking asylum must
show (1) that he has a subjective fear of persecution based on race, religion,
nationality, social group membership, or political opinion, (2) that a
reasonable person would have a fear of persecution in that situation, and
(3) that his fear has some basis in objective reality.</li>

Nationality Act (INA) authorizes the Attorney General, in her discretion,
to confer asylum on any "refugee." 8 U.S.C.S. § 1158(a). The INA
defines "refugee" as a person unwilling or unable to return to
his native country because of persecution or a well-founded fear of
persecution on account of race, religion, nationality, membership in a
particular social group, or political opinion. 8 U.S.C.S. §
1101(a)(42)(A). There are three elements the alien must establish to
qualify for withholding of deportation or asylum based on membership in a
particular social group. The alien must (1) identify a group that constitutes
a "particular social group," (2) establish that she is a member
of that group, and (3) show that she would be persecuted or has a well
founded fear of persecution based on that membership.<o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; mso-list: l0 level1 lfo1; text-align: justify;">To demonstrate
membership in a particular social group, a petitioner must show
persecution that is directed toward an individual who is a member of a
group of persons all of whom share a common, immutable characteristic. The
shared characteristic might be an innate one such as sex, color, or
kinship ties, or in some circumstances it might be a shared past
experience such as former military leadership or land ownership. The
particular kind of group characteristic that will qualify under this
construction remains to be determined on a case-by-case basis. However,
whatever the common characteristic that defines the group, it must be one
that the member of the group either cannot change, or should not be
required to change because it is fundamental to their individual
identities or consciences. </li>

for the court is whether the agency's answer is based on a permissible

Defendant was convicted of four state crimes prior to his
deportation. At the time of his deportation hearing, the Board of Immigration
Appeal retroactively applied the 1996 amendments to the Immigration and
Nationality Act, finding him ineligible for relief under 8 U.S.C.S. § 212(c).
He was deported but reentered the United States. He was charged with illegal
reentry into the United States. The court dismissed the indictment based on a
finding that the underlying deportation order was not consistent with due
process. The court of appeals vacated the dismissal and remanded for findings
of whether the fundamental procedural error in the deportation hearing was
prejudicial. The court found that defendant was not "prejudiced" by
the error and reinstated the indictment. Given the gravity of defendant's
criminal record, he would have been required to demonstrate the existence of
unusual or outstanding countervailing equities in order to obtain § 212(c)
relief. Despite substantial evidence that many individuals convicted of serious
crimes were granted § 212(c) relief, defendant was an individual whose criminal
record was extraordinary and whose equities were underwhelming.<o:p></o:p></div>

deportable by reason of two narcotics convictions, the alien must make a
showing of unusual or outstanding countervailing equities to obtain a waiver
of deportation. The necessity of demonstrating unusual or outstanding
equities is not exclusively triggered by serious crimes involving
controlled substances, however. Rather, one must examine the gravity of
the offense, per se. In addition, such a showing may be mandated because
of a single serious crime or because of a succession of criminal acts,
which together establish a pattern of serious criminal misconduct.
Finally, an alien who demonstrates unusual or outstanding equities, as
required, merely satisfies the threshold test for having a favorable
exercise of discretion considered in his case; such a showing does not
compel that discretion be exercised in his favor. The Board of Immigration
Appeals has found, inter alia, family ties, long residence in the country,
arrival at a young age, emotional hardship to family members upon
deportation, gainful employment and difficult childhood experiences to
constitute unusual or outstanding equities. The presence of unusual or
outstanding countervailing equities will not necessarily outweigh adverse
factors.</li>
</ul>

order of the Board of Immigration Appeals (BIA), not those of the
Immigration Judge (IJ). The BIA has the power to review an IJ's findings
de novo, to make its own findings even as to matters of credibility, and
to assess the legal sufficiency of the evidence.<o:p></o:p></li>

eligible for asylum if he is a refugee, and a refugee is any person who is
unable to return to his or her country because of persecution or a
well-founded fear of persecution on account of race, religion,
nationality, membership in a particular social group, or political
opinion. The standard for proving a well-founded fear of persecution is
the reasonable person test. Therefore, an individual seeking asylum must
show (1) that he has a subjective fear of persecution based on race,
religion, nationality, social group membership, or political opinion, (2)
that a reasonable person would have a fear of persecution in that
situation, and (3) that his fear has some basis in objective reality.</li>
