Court made the following holding:
- Aliens lawfully admitted
for permanent residence who temporarily proceeded abroad voluntarily and
not under an order of deportation, and who are returning to a lawful
unrelinquished domicile of seven consecutive years, may be admitted in the
discretion of the Attorney General. 8 U.S.C.S. § 1182(c). As long as the Board of
Immigration Appeals may reconsider or reopen the case, the status of the
petitioner in that case for purposes of 8 U.S.C.S. § 1182(c) relief has
not been finally determined for purposes of action by the Board.
