Facts:
The alien was ordered removed after having been admitted
to the United States. Immigration and Naturalization authorities could not
locate a country amenable to receive the deportable alien, so the alien was
detained indefinitely. Aliens filed for habeas corpus relief under 28 U.S.C.S.
§ 2241, which the Court held was proper for jurisdictional purposes..

Virginia Court made the following holding:
- When an alien has been found to be unlawfully present in the United States and a final order of removal has been entered, the government ordinarily secures the alien's removal during a subsequent 90-day statutory "removal period," during which time the alien normally is held in custody. Pursuant to 8 U.S.C.S § 1231(a)(6), further detention is authorized if the government fails to remove the alien during those 90 days.
