The
Virginia Court made the following holding:
- Eligibility under § 208
the Immigration and Nationality Act of 1952, 8 U.S.C.S. § 1158(a),
therefore depends upon whether the alien is a refugee, as defined in 8
U.S.C.S. § 1101(a)(42)(A).
- Proof of a well-founded
fear of persecution does not require the asylum-seeker to show by
objective evidence that it is more likely than not that he or she will be
subject to persecution upon deportation, the standard which an alien must
meet in order to receive withholding of deportation under §243(h) of the
Immigration and Nationality Act of 1952, 8 U.S.C.S. § 1253(h).
- A standard applicable to requests for asylum requires that the petitioner present specific facts establishing that he or she has actually been the victim of persecution or has some other good reason to fear that he or she will be singled out for persecution.
